Welcome to Boncharter(https://www.boncharter.com). Before proceeding with the reservation request and payment for the rental of one of our boats, please read carefully these General Conditions of Reservation Request and Online Purchase (hereinafter referred to as “Purchase Conditions”).
By making a reservation request and the corresponding payment through our website, you declare to know and accept these Terms and Conditions of Purchase, as well as our Privacy Policy. These Conditions of Purchase govern the initial phase of your request. The rental will be definitively formalized by signing the full Pleasure Boat Rental Agreement (hereinafter referred to as the “Master Agreement”), which will be sent to you once your reservation is confirmed by us.

2. OBJECT
These Terms and Conditions of Purchase regulate the booking request and prepayment process for the rental of the pleasure boats offered by Boncharter through its website. The specific characteristics of the selected boat, the contracted services and the final price will be detailed in Annex II (Summary of the Reservation and Contracted Services) of the Main Contract.
3. RESERVATION REQUEST AND PAYMENT PROCESS
The process of securing your lease consists of the following steps:
- Step 1: Application and Payment by the LESSEE. You will select the boat, dates, type of rental and desired extras through our online reservation system. To formalize your reservation request, you must pay 100% of the “Subtotal contracted services” that will be indicated. Payment must be made within 24 hours of the date of your reservation request. If full payment is not received and credited to our account within this period, your reservation request will be automatically cancelled without prior notice, and the boat will become available.
- Step 2: Confirmation (or Denial) by the LESSOR. Once your payment has been successfully received, Boncharter will have a maximum of 24 hours to review your request and confirm the reservation.
- If we confirm your reservation, we will proceed according to Steps 3 and 4.
- If we are unable to confirm your reservation for reasons not attributable to you (e.g. unavailability of the boat), we will refund the full amount paid as soon as possible.
- If, after receiving your payment, we are unable to confirm the reservation due to reasons attributable to you (e.g. incorrect or incomplete information, failure to meet essential requirements such as valid qualification for the chosen modality, etc.), we may refuse the reservation. In this case, we will refund the amount paid, deducting 50 € (fifty euros) for management fees.
- Step 3: Request of Data for the Contract by the LESSOR. After confirming your reservation, we will ask you for the necessary personal data (yours, of all passengers on board, and of the designated skipper, if applicable) to complete the Main Contract and its Annexes, as well as to comply with the current maritime regulations regarding the declaration of passengers. You undertake to provide this information truthfully and completely.
- Step 4: Submission and Acceptance (Online or In-Person) of the Master Agreement. Once the information has been compiled, we will send you the complete Master Contract (with all its Annexes) for your reading and acceptance. This acceptance can be done online through the means that we provide, or in person at our offices or at the point of embarkation before the delivery of the boat. This Master Contract is the document that will legally govern the rental. Failure to accept the Master Contract by any means prior to the commencement of the charter may be considered a cancellation on your part, and the conditions detailed in section 5 of these Conditions of Purchase shall apply.
4. FINAL FORMALIZATION OF THE LEASE
The reservation is considered secured once Boncharter confirms it (Step 2). However, the rental is perfected and fully binding on both parties with the acceptance (online or in person) of the completed Master Agreement by you (Step 4). This Master Agreement will detail all obligations, rights and conditions of service.
Acceptance of the Master Contract is essential prior to delivery of the vessel. If the contracting has been initiated through other channels (telephone, email) and you have not accepted these Online Purchase Conditions, the signing of the Master Contract prior to pick-up of the vessel is also mandatory.
5. CANCELLATION POLICY AND RIGHT OF WITHDRAWAL
Right of Withdrawal: Pursuant to Article 103, paragraph l) of Royal Legislative Decree 1/2007 of November 16, 2007, approving the revised text of the General Law for the Protection of Consumers and Users, the right of withdrawal (the right to cancel a distance contract within 14 days without justification) is not applicable to contracts for the provision of services related to leisure activities if the contracts provide for a specific date or period of performance. Since the rental of a pleasure boat is a leisure activity for a specific date, you do not have a statutory right of withdrawal once the booking has been confirmed.
Tenant Cancellation Policy and Procedure: Notwithstanding the foregoing, Boncharter offers the following voluntary cancellation policy. To cancel your reservation, you must give clear and unequivocal notice in writing.
- How to request cancellation:
- E-mail: Send your request to booking@boncharter.com, indicating your full name and booking reference.
- Phone: You can communicate your intention to cancel by calling +34 681 90 75 75 77, although the cancellation must be confirmed in writing via email to be effective.
- Effective date of cancellation: The date to be taken into account to apply the cancellation conditions will be the date of receipt of your written communication.
Cancellation Conditions (Penalties): Once your booking has been confirmed by Boncharter, if you decide to cancel, the following conditions (detailed in Clause 10.4 of the Master Agreement) will apply:
- With 30 days or more prior to the start of the service: 100% refund of the amount paid, minus a 50 € handling fee.
- Between 29 and 15 days in advance: 50% refund option or 100% credit redeemable in 6 months (subject to availability).
- Between 14 and 7 days in advance: No refund. 100% credit redeemable in 6 months (subject to availability).
- Less than 7 days notice: No refund (loss of 100%). A 100% credit redeemable in 6 months (subject to availability) will only be offered if the cancellation is due to force majeure duly justified (medical certificate, police report) presented within 48h.
6. ADVERSE WEATHER CONDITIONS
Safety is our priority.
- If Boncharter determines that weather conditions are objectively dangerous and prevent the start of the rental (according to criteria defined in Clause Nine of the Master Agreement), we will offer you a full refund, a voucher or a postponement of the reservation.
- If the conditions are safe to sail but not to your personal liking, the decision to sail is yours. If you decide not to sail, it will be up to the goodwill of the parties to try to agree on a change of date, with no obligation for Boncharter. If there is no agreement, there will be no compensation.
7. DEPOSIT
For the rental of the boat, a deposit will be required prior to embarkation. The options and amounts are detailed in Annex VIII of the Main Contract and you will be informed during the booking process. This deposit covers possible damages, losses, costs of fuel not replaced, special cleaning, etc.
8. FUEL
The fuel policy is generally “full/full”: the boat is delivered with a full tank and must be returned in the same condition. The cost of fuel consumed is borne by the lessee. Specific details can be found in Annex VIII of the Main Contract.
9. PRINCIPAL OBLIGATIONS OF THE LESSOR (Summary)
By chartering a boat with Boncharter, you (and your designated skipper, if applicable) agree, among other things, to:
- Use the boat in a diligent and safe manner, respecting the regulations.
- Declare truthfully the number and, if required by regulations, the details of all passengers on board.
- Not to exceed the maximum number of persons on board authorized for the vessel.
- Do not govern under the influence of alcohol/drugs.
- Return the boat on time and in the same condition in which it was received (except for normal wear and tear).
- Accept the risks inherent to navigation (according to Annex I of the Main Contract).
The complete obligations are detailed in the Master Agreement.
10. APPLICABLE LAW AND JURISDICTION
These Conditions of Purchase and the Main Contract are governed by Spanish law. For any dispute, an amicable solution and mediation will be attempted. If this is not possible, the competent jurisdiction will be that of Palma de Mallorca for businessmen, or the one that corresponds legally if you are a consumer.
11. LANGUAGE
This document and the Master Agreement are originally drafted in Spanish. In case of translations, the Spanish version shall prevail.
12. ACCEPTANCE
By checking the corresponding box and proceeding with the reservation request and payment, you declare that you have read, understood and accepted these General Conditions of Reservation Request and Online Purchase.
